OVERVIEW (NOT PART OF CONDITIONS)

Principal entry requirement: Entrants (who must be eligible persons 13 years of age, or older) must purchase from any participating retail outlet anywhere in Australia one specially marked MARS 53g or 72g (each a "Promotion Product").

Competition Period: commences at 00:00 hrs on 1/3/14 and ends at 24:00 hrs on 30/9/14 (local time in place of prize claim).

Entry method: in participating retail outlets at point of sale.

Max Prizes and their $RRP:

  1. 166,520 x MARS 53g each valued at $1.85;
  2. 475,136 x MARS 72g each valued at $2.14;

Maximum Total Prize Value:
The maximum total value of all prizes available to be won is $1,324,853

Prize distribution: : One in 6 Promotion Products will be packaged in a wrapper entitling the holder to one of the instant win prizes (being a product of the same type as the bar that was wrapped in the Winning Wrapper (“Prize Bar”). The size of the Prize Bar will be the same as the bar that was packed in the Winning Wrapper. The holder of such a wrapper may claim the Prize at a retail outlet that sells Promotion Products by handing over the wrapper during the Competition Period.

CONDITIONS

    PARTICIPATION
  1. This competition (“Competition”) is conducted by Mars Australia Pty Ltd, ABN 48 008 454 313, trading as Mars Chocolate Australia, of Ring Road, Ballarat VIC 3350 (“Promoter”).
  2. Entry to the Competition constitutes acceptance of these conditions.
  3. Entry to the Competition is only open to “Eligible Entrants”, being individuals who: (i) are in Australia and (ii) are 13 years of age, or older.
  4. The period during which prize claims can be made ("Competition Period") commences at 00:00 hrs on 1/3/14 and ends at 24:00 hrs on 30/9/14 (local time in place of relevant Prize claim).
  5. In this Competition, a "Promotion Product" is: (i) any MARS 53g or 72g, product packed in a pack that refers to the Competition and which is purchased from any participating retail outlet anywhere in Australia.
  6. There is a maximum of 3,849,936 Promotion Products available to be purchased.
  7. INSTANT WIN PRIZES
  8. One in 6 of the Promotion Products is packaged in a wrapper that entitles its holder to a Prize (each such wrapper is a "Winning Wrapper").
  9. Winning Wrappers are identifiable by text on the inside surface of the wrapper that states "FREE BAR WINNER" (the “Winning Statement”). If the Winning Statement is not printed on the inside surface of a wrapper, it is not a Winning Wrapper.
  10. Each Winning Wrapper entitles the holder to a free bar of the same type as the bar that was wrapped in the Winning Wrapper (“Prize Bar”). The size of the Prize Bar will be the same as the bar that was packed in the Winning Wrapper. For example: a Winning Wrapper from a MARS 53g bar entitles the holder to a free MARS 53g bar. The free bar may, or may not, be a Promotion Product.
  11. There is a maximum of 641,656 prizes available to be won.
  12. The pool of prizes available to be won comprises a maximum of:
    1. 166,520 x MARS 53g each valued at $1.85;
    2. 475,136 x MARS 72g each valued at $2.14;
  13. The maximum total value of all prizes available to be won is A$1,324,853.
  14. In order to claim a Prize, a holder of a Winning Wrapper must, during the Competition Period, take the wrapper to a retail outlet that sells Promotion Products and must hand the wrapper over at that retail outlet.
  15. Only bona fide Winning Wrappers will be honoured. These may include unique security measures to guard against fraud. The Promoter and participating outlets may conduct security verification checks in their absolute discretion. A Winning Wrapper is void if the Winning Statement does not appear in its entirety, or the Winning Wrapper is stolen, forged, mutilated or tampered with in any way or if it, or any part of it, fails any of the security and verification checks. The following provisions of this condition only apply to Prize claims that are made by residents of NSW or Victoria, or are made by persons who purchased a Promotion Product in NSW or Victoria: (i) unless otherwise due to fraud or ineligibility under these conditions, all Prize claims in excess of the number advertised as available (but otherwise in accordance with these conditions) will be honoured; and (ii) printing and other quality control errors outside the control of Eligible Entrants will not be used as the sole basis for refusing to honour a Winning Wrapper.
  16. GENERAL
  17. Except as expressly stated, the values of prizes are Recommended Retail Prices (“RRP”) as at 11/12/13. The RRPs may vary during the Competition Period.
  18. If any Prize is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if any Prize is unavailable for any reason.
  19. Rights to receive Prizes are not transferable or exchangeable and cannot be taken as cash
  20. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
  21. All of the Promoter’s decisions are final and no correspondence will be entered into.
  22. To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an entrant’s rights under the Competition and Consumer Act 2010;
